Article 1 - Scope of application

The present general terms and conditions of sale (the "GTC") apply to all orders placed on the website www.bodypack.fr (the "website") relating to the purchase of products presented by MML , a simplified joint stock company whose registered office is located at ZA de la Ronze, 300 rue des Carrières, 694000 TALUYERS, registered with the Lyon Trade and Companies Register under number 959 503 160 (intra-community VAT number FR57959503160).


Subject to any contrary provision of the law, the GTC applicable to the relationship between MML and the Customer shall be those in force on the day of the validation of the order. They apply to the exclusion of all other conditions. As MML does not carry out any cold calling, the provisions of the Consumer Code relating to cold callings are therefore inapplicable to orders covered by these GTC.

Article 2 – Orders


Orders are made exclusively on the site. Connection and internet access costs are at the customer's expense. All orders are validated by the customer by means of a "click", which constitutes an irrevocable acceptance that can only be challenged within the limits provided for in the GCS. Any order implies prior knowledge and acceptance without reservation of the GCS.

In accordance with the law, the procedure known as the "double click", associated with the authentication and non-repudiation procedure, as well as the protection of the integrity of the messages, constitutes an electronic signature, which has value between the parties in the same way as a handwritten signature. In the absence of proof to the contrary, the data recorded by MML shall constitute proof of all transactions between MML and its clients.

A confirmation of the order validated by the customer shall be sent to them by email prior to the dispatch of the order, and will make the sale final and subject to the right to exercise the right of retraction. The version of the GCS applicable to a given order may be kept by the Customer by computer recording or printing on paper.

Article 3 – Availability

Product and price offers are valid as long as they are visible on the site, within the limit of available stocks, excluding promotional operations indicated as such on the website. The sales are concluded subject to the effective availability of the products.

In the event that a product ordered proves to be unavailable, for reasons beyond the control of MML, the customer will be informed by email. The order will be automatically cancelled and no bank debit will be made. MML reserves the right to offer the customer a replacement product of equivalent quality and price.

Furthermore, MML reserves the right to refuse orders for a large quantity of the same product for two or more identical items. MML also reserves the right to refuse any order from a customer who has not paid for a previous order (except in the cases of retraction provided for by law).

Article 4 - Price and payment terms

4.1 - MML reserves the right to change its prices at any time but the products will be invoiced on the basis of the prices in force at the time the customer validates the order.

Product prices are indicated in Euros, including all taxes (including VAT at the current rate).

The products remain the property of MML until full payment of the price.

4.2.1 - Regulation B2C :

The payment of orders is made by credit cards (VISA, MASTERCARD, other credit cards) or paypal.

4.2.1 - B2B payment :

The payment of orders is made by credit card (VISA, MASTERCARD, other credit cards) or Letter of Credit.

Article 5 – Delivery

The delivery times indicated are in working days. No deliveries will be made to hotels or post office boxes.

Delivery without signature at home is available in France, Belgium and Switzerland.

Relay point delivery is available in France, Austria, Belgium, Spain, Estonia, Latvia, Lithuania, Luxembourg, the Netherlands, Portugal, Poland, Sweden and the United Kingdom.

In the event of a delay in shipment, an informative email will be sent to the customer and a new date will be proposed. If the delay in delivery should exceed 7 days for reasons other than force majeure, the customer will have the option of cancelling the order by sending a registered letter with acknowledgement of receipt to MML's customer service department at the address of its registered office within 60 working days from the originally scheduled delivery date. The sums paid by the customer for the order will be refund. If the product has been received after the date of receipt of the cancellation by MML, the return costs will remain the responsibility of the customer, and the return of the products shall only be accepted subject to the products being in perfect condition, in their original packaging.

Any reservation on the condition of the products (e.g. open or damaged package) must be notified immediately at the time of delivery.

Article 6 – Withdrawal

Pursuant to Articles L 121-20 and following of the Consumer Code, the customer has a period of 7 clear days from the date of delivery of the order to return any product in its original packaging and in perfect condition (allowing for re-marketing), to request an exchange or refund without penalty, with the exception of return costs, which remain the responsibility of the customer. The customer will have to join a copy of the invoice or any other element making it possible to identify the order in question, and its holder.

Only the customer identified as such to MML may exercise this right, to the exclusion of any other person, and in particular the person to whom the delivery is addressed.

The return address is: SAS MML - ZA de la Ronze - 300 rue des Carrières - 69440 TALUYERS.

The refund of the product(s) shall be made by MML within a maximum period of 30 days after receipt by MML of the said products.

Article 7 – Compliance

The photos are given for information only. The customer is invited to refer to the description of each product to know its precise characteristics. In case of doubt, or to obtain additional information, it is possible to contact customer service: contact@bodypack.fr for B2C customers and contact-pro@bodypack.fr for B2B customers.

MML undertakes to refund the customer or to proceed with an exchange of products which are apparently defective, damaged or damaged or which do not correspond to the order.

In this case, the customer shall report the situation in writing with details and supporting photographs. In some cases, the customer may be asked to return the product(s).

The return costs will be refund on presentation of the supporting documents.

In any case, the customer benefits from the legal guarantees of conformity and latent defects, in accordance with the legal provisions in force (articles L211-4, L211-5 and L211-12 of the Consumer Code and articles 1641 and 1648, first paragraph, of the Civil Code).


Article 8 – intellectual and industrial Property

All illustrations, images, characters, presentation methods, graphics, characters on the website are and remain the exclusive property of MML or of the holders of the said rights having granted a right of use to MML. Any reproduction, representation or use of said rights by a customer will constitute a fault giving rise to legal proceedings.

Article 9 –  Data processing and liberties - Personal data

The information and data concerning the customer are strictly necessary for the management of orders, the execution and follow-up of commercial relations, as well as for internal statistical purposes.

The database thus constituted has been declared to the CNIL under the n°1637447.

This data may be transmitted to the companies involved in these relations (such as those responsible for the execution of services and orders) for their management, execution, processing and payment. This data is also kept in order to pursue security, identification, improvement and personalization of services.

The customer has at any time the right to access, rectify and oppose personal data concerning them. This right can be exercised by email at contact@bodypack.fr or by post SAS MML - ZA de la Ronze - 300 rue des Carrières - 69440 TALUYERS.

The customer is likely to receive, from MML, offers concerning products or services similar to those already ordered, or newsletters. The customer shall have the right to object at any time and at no cost for the future, according to the terms and conditions specified in each mailing.

Article 10 – Applicable law - Disputes

The contract formed by the acceptance of these GCS is subject to French law.

The language of this contract is the French language.

In the event of a dispute, the courts of Lyon shall have sole jurisdiction.

Article 11 - Product Life Guarantee

In order to activate the "Product Life" warranty you just have to register your product on our website within 3 months after your purchase: https://bodypack.fr/pages/activer-la-garantie

If the “Product Life” warranty is not activated, the product will only be guaranteed for 2 years, and subject to the conditions defined below: Productlife page. In our Lifetime Warranty policy we give preference to replacement or repair of the product. However, if this is not possible, a refund will be made.


We will apply a refund based on the life cycles of your product according to our obsolescence rule:


Up to 3 years - 100%.

More than 3 years to 5 years - 80% of the purchase price refund

More than 5 years to 7 years - 65% of the purchase price refund

More than 7 years to 10 years - 50% of the purchase price refund
